男趁女服藥昏睡性侵　判男賠15萬元

【楊勝裕／新竹報導】新竹縣一名曾姓男子2011年間在網路聊天室結識一名女子，未料曾男當年7月與妻離婚，無家可歸，女子好心收留曾男，兩人成同居室友。8月間，曾男見女子吃了抗憂鬱藥物，竟起性慾，向女子求歡，女子拒絕抵抗，但藥物發作無力反抗，曾男竟趁機性侵，直到他發現女子因藥物昏睡才停手，事後醒來發現遭曾男性侵，怒控對方。刑事部份，曾男遭妨害性自主罪判1年7個月，緩刑2年。

被害女認為曾男明知她患有嚴重憂鬱症，連看三年醫生，竟利用她服藥之際，性侵她，造成身心嚴重受創，需要深度治療，無法工作，向新竹地院提出民事告訴，求償35萬元。法官審酌，認曾男造成被害女嚴重受傷，但因被告無業，且收入不穩定，因此判曾男應賠15萬元給被害女。
