夫婦駕車離奇墜崖　國壽判賠6400萬元定讞

【劉昌松／台北報導】新北市老夫妻許文同、許嚴麗媖在2001年桃芝颱風期間，駕車行經北部濱海公路時，意外墜崖，始終未尋獲遺體，雖法院認定當天風雨不足以將車輛吹落山崖，但許氏夫妻可能因其他意外墜崖掉落海中沖走，判國泰人壽應依意外險理賠許的子女共6400多萬元定讞。

許氏夫妻因意外失蹤後，已經被法院宣告死亡，但國泰人壽懷疑，許氏夫妻可能是為了躲避龐大債務，自導自演這齣沒有屍體的天災意外事故，不但打官要求撤銷死亡宣告，也要向許的子女索討已經付出的理賠金。

但法院認為，許氏夫妻本來就有買保險習慣，而夫妻向國泰買的這兩份都是「意外險」，雖然經查證許氏夫妻的車子不是因風雨而意外落崖，但國泰無法證明許氏夫妻沒有遇到其他意外，因此法院維持許氏夫妻的「死亡宣告」，判國泰仍應依「意外死亡」理賠，案經最高法院駁回上訴定讞。
