查黑心油　吳秀明：公平會配合調查，但不會以公平法開罰

對於民眾相當關心的黑心油事件，公平交易委員會主委吳秀明今（31）日表示，公平會會配合調查，但因「食管法」是特別法，優於普通法，且基於一事不二罰的原則，公平會不會以「公平法」來處罰違法廠商。

立法院經濟委員會今日審查公平會預算，對於近來的黑心油事件，民眾對食品安全問題憂心忡忡，立委也是氣憤不已，多位朝野立委紛紛詢問，為何不能以標示不符的廣告不實來處分黑心業者，且公平法的罰款金額可高達2,500萬元。

吳秀明表示，公平會有參與食品安全的聯合稽查小組，而「食品衛生管理法」與「公平交易法」中雖然都有針對廣告不實的處罰，但因食管法是特別法，公平法是普通法，基於特別法優於普通法的原則，是依食管法來處理。

吳秀明指出，且基於一事不二罰的原則，公平會不會再以公平法來處罰違法廠商，而衛生福利部依食管法開罰的金額也已罰到18億元。
