酒測值2.1走直線沒問題　男無罪定讞

有酒駕前科的陳姓男子去年7月16日早上7時許，和朋友酒聚後騎車回家，因未兩段式左轉被警察攔住，經檢測後酒測值高達每公升2.1毫克，被移送公共危險罪嫌。但他通過直線測試、平衡動作，也成功畫出同心圓，法院認定他並無不能安全駕駛，判他無罪定讞。

陳男說，若真的酒測值這麼高，「我應該是昏睡、癱軟的程度，還能住做完警詢筆錄嗎？可能是我配合度太高，吹太用力，造成爆機。」

榮總鑑定結果認為，酒測值超過2，常人的平衡度應已不穩、精神混亂，但每個人對酒精反應不同，少數個案因肝臟代謝速度快，仍能保持協調的肌肉及中樞神經功能。
