大埔案持續引起政府徵收人民土地正當性的爭議，針對民進黨立院黨團表示將提案修正土地徵收條例，內政部長李鴻源今（22）日說，土地徵收是國家進行重大建設不得已的手段，法不是不能修，但重點是要能夠操作，若修到「誰都動不了」，也非國家之福。
大埔事件起於竹南科大埔都市計畫案，苗栗縣政府區段徵收大埔居民土地引起抗爭，經行政院協調指示大部分居民原屋保留、農地集中後，仍有4戶因不符法規且拒遷，最後被縣府依法強制拆除，引發土地正義爭議，繼而發展成民間團體與群眾聲援，造成大規模公民抗爭行動，引起社會矚目。
民進黨立院黨團對此表示，將把「土地徵收條例」納為下會期優先法案，針對包括那些地方適用區段徵收、發回比例，以及地主不願參與開發的保障機制等，都列為修法檢討，讓土地徵收制度合理、透明化。
對此，李鴻源強調，法不是不能修，而是應讓法律更兼顧保障大眾、小眾的權益，也要讓需地機關達成工程的進度，土地徵收是國家進行重大建設的不得已手段，只是能不能做得更有技巧，是有很大需要改善的空間。
不過，李鴻源也說，土地徵收法的立意是良善的，且在去年才修完法，雖然不是不能再修，但重點是要能夠操作，若修到「誰都動不了」，也非國家之福，內政部會與各行業、立委溝通，找到平衡點。
李鴻源說，內政部週一會安排次長與專家學者、各地方政府機關進行首批座談，進行通盤檢討，評估是否應修法，若不須修法，就在施行細則中強化，在座談完畢後做判斷。
針對民進黨團將在下會期提案修法，李鴻源表示，尊重立委的意見，內政部會在看過立委的版本後，與專家學者、地方政府座談完畢後，也會提出自己的版本，屆時會就各版本再進行協商。
