軍審移司法 林毅夫案持續通緝中

外界擔憂當年叛逃的林毅夫可能因軍審法新制解套，對此國防部法律事務司審判處副處長沈世偉表示，林毅夫是以陸海空軍刑法第24條「投敵」罪通緝，屬繼續犯，明年1月中起才會移交司法機關處理。

沈世偉表示，國防部去年曾與法務部協調，法務部再次確認投敵是繼續犯，「犯罪追訴權時效還沒開始算，目前依法通緝中」。林毅夫案移送到司法檢察署後，將由檢察官繼續接辦，決定是否再發布通緝。
