外界質疑環保署修正環評法，是否為美麗灣、悠活等開發案解套？環保署解釋，這次修訂的環評法草案，只針對水庫集水區進行修改，並沒有包括國家公園、自來水保保護區；反對的環保團體認為，開放水庫集水區免環評，會嚴重破壞水質，強烈反對修改法案。
環保署表示，提出修改環評法條，是由於屏東、台南、南投等地方政府認為環評法過於嚴苛，影響當地經濟發展，研擬將現行法條改為只要有主管機關同意，工廠、砂石業者及農用道路開發集水區就能免除環評流程，同時強調並沒有將國家公園及自來水保護區列入修正案，根本和美麗灣、悠活等爭議開發案沒有相關。
環保署擬修放寬2級水庫集水區的低汙染性工廠，法案將針對土石採取碎解、洗選場開發免除環評，只要工廠設有污水處理設施，且放流口距離水庫蓄水範圍邊界1公里以上，有當地主管機關的同意，就能免除環評直接進行開發。
環保署強調，這次擬修環評法並非為美麗灣等企業開發案開大門，另免環評的農業道路開發案僅限定寬度未滿4公尺、長度未滿500公尺，經農業主管機關同意者，才可免實施環評。
而外界認為保護區開發案免環評，將有利於國內天然氣、石油的碳封存產業開發，環保署表示，過去國內並沒有確切的碳封存開發限定法案，因此研擬限定開發量，以二氧化碳注入量10萬公噸為限，但將再評估注入量是否過於寬鬆，並未確切定案。
針對研擬修改環評法條例，反對團體強烈表示，環評法修改將會影響台灣水質的保護，造成水庫資源的破壞，恐造成人民健康受損，呼籲環保署不應鼓勵汙染性產業在保護區內設立工廠，保障國人用水品質，及完善的環境生態保護。
