1.我國刑事案件並未採取律師強制辯護制度，檢察官起訴後，被告若未具備法律專業知識，兩造在法庭上之攻擊防禦有違武器平等原則，將剝奪人民訴訟權，減損人民對司法之信賴。法律扶助案件，即為補充上開制度之缺陷，由財團法人法律扶助基金會（簡稱基金會），結合各地律師公會之力量，對於無資力之被告提供刑事訴訟之辯護。被告如果想要依法律扶助法向財團法人法律扶助基金會（或分會）提出申請，法院一定會提供必要的協助。
簡單化:會有法扶基金會指派律師代為辯護
