沒替員工加保團體險　公司判賠家屬318萬

高雄國登營造公司在2010年3月間，誤認一名徐姓臨時工已離職，向保險公司辦理退保，後來發現錯誤，趕緊用傳真方式，幫徐再次投保團體保險，但未向保險公司確認保單，隔年徐因車禍死亡，家屬才發現公司根本沒幫徐家保團體保險，無法請領徐的住院日額、身故理賠共計318萬元，憤而轉向國登營造求償。

高雄高分院認為，國登營造本來就會從員工薪資中，扣除部分款項加保團體保險，也就是國登公司受勞工委任加保，但國登卻未盡到受託責任，導致徐損失團保理賠金，而徐死後，理賠金成為遺產，因此判國登要賠償徐家人本可拿到的遺產318萬，案經最高法院駁回上訴定讞。
