無被害人告黃世銘涉《個資法》　北檢未辦

【呂志明／台北報導】台北地檢署偵辦檢察總長黃世銘洩密案，今天以黃涉犯《刑法》洩密罪及違反《通訊保障及監察法》起訴，至於黃是否涉犯《個人資料保護法》，因《個資法》屬於告訴乃論罪，又沒有被害人提出告訴，故北檢並未偵辦。

據了解，全案共有130餘人提出告訴、告發，案件達70餘件，其中只有立委柯建銘主動提告，但案由是濫權監聽，其餘立法院長王金平、法務部前部長曾勇夫、高檢署檢察長陳守煌、檢察官林秀濤，都未提出任何告訴。

依照《個資法》41條第1項規定，洩漏個人資料足生損害他人時，可處2年以下有期徒刑，但這個部分為告訴乃論之罪。

北檢指出，雖然全案有不少告發人，控告黃世銘等人涉犯《個資法》，但這些人都不是被害人，而遭到監聽並被公布監聽譯文的王金平等人又未提出告訴，除非這些被害人能夠主動提告，北檢才能偵辦。
