呻吟不算通姦　行車紀錄器舉證無用

一名陳姓男子因懷疑妻子外遇通姦而檢查妻子行車紀錄器，結果果然聽到呻吟聲，一怒之下提告通姦，但檢方最後以無法證明有性器接合為由，將全案不起訴處分。

根據了解，陳男懷疑張姓妻子與黃姓同事有不倫關係，因而查看妻子車上的行車紀錄器，結果不僅發現妻子和黃男曾開車上合歡山，還錄到兩人相約洗溫泉和呻吟聲，因此憤而提告通姦。

但台北地檢署檢方在勘驗相關證據後認為，雖然陳男有錄到妻子呻吟聲，但並不能據此就認定兩人有性器接合行為，將全案不起訴處分。
