智能低下？　姦殺葉小妹仍判免死

性侵累犯林國政，假釋出獄40天隨即又犯下泯滅人性的雲林葉小妹姦殺案，雖然一、二審都被判處死刑，但最高法院卻以「智能低下」等理由，改判無期徒刑；全案經立委聲請發常上訴後，最高法院仍在今（18）日駁回聲請。

對於該案最高法院表示，由於非常上訴之聲請僅限於對被告有利，因此上訴主張改判死刑顯然不符非常上訴規定，且聲請理由也沒明確指出最高法院判決無期徒刑有何違背法令之處，因此駁回聲請。

當初立委聲請上訴時，檢察總長雖然認定林國政並非智能低下，但在沒有確切證據可以推翻最高法院認定標準的情形下，要想成功翻案恐怕不太可能。
