綠委提案修法　監聽排除通姦等輕罪

【林修卉╱台北報導】民進黨立委林佳龍與高志鵬今舉行「立刻修法、終結違憲監聽」記者會，主張調取通聯紀錄須由法院核發調取票，並以「最重本刑三年以上之罪」為要件，排除通姦、妨害名譽等輕罪。

林佳龍表示，他已完成連署並提案修改《通訊保障及監察法》與《刑事訴訟法》，將限制另案監聽與調取通聯、監聽票改專庭核發、國會通案監督，以及加強事後救濟，讓受監聽人在事後可向法院提起抗告，請求權利救濟或確認監察處分違法。

林佳龍還說，主管機關每年須定期公告申請監聽的准駁比例、案由、線路數、線路種類、法院知與不通知比例及督察情形，相關通案數據送交立院審查後，由立院製作並公布年度報告。
