以下有關劇情... 第1集果然有滿滿的笑點， 但我有2個關於法律的問題： 第1： 之前曾經看過一本"與絕望奮鬥"的日譯書， 裡面提到日本法院判決死刑時通常都會先念理由再念主文... 主要是因為如果直接念主文容易造成被告情緒崩潰， 所以會先念理由來讓被告有心理準備再接受死刑判決的結果， 所以劇情中先念主文再念理由這段是不是有點順序錯置？ 第2： 台灣法院如果是宣判死刑or無期徒刑， 依照台灣刑事訴訟法344條法院應該直接職權上訴， 所以劇情當中被告不想上訴是不是只是劇情沒交代清楚？ 她只是不想委任古美門律師... 因為她又有提到她不想上訴所以案件結束了， 台灣殺人罪和第三審都是強制辯護，所以就算被告不委任， 法院也會幫忙找辯護人， 所以如果古美門堅持要幫被告辯護法院也是可以指定古美門， 我想台灣和日本都是大陸法系應該以上規定都是相同的， 還是那都是我腦補，日本刑事訴訟法沒有這些規定？ -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 111.241.44.16
