改採行政罰法　農委會持續研議

混充米事件持續受到關注，農委會26日針對「糧食管理法」修法方向邀集糧商業者、法治專家討論。除了農委會現行規畫將罰則到300萬元，面對外界批評「無牙老虎」，也不排除研議改以以行政罰法追討業者「不當利得」，讓糧商不再「罰不到、罰不怕」。

環保署從2008年起，以行政罰法18條追討不當利得，至今累計近30案例，去年曾對台泥集團投資的花蓮和平火力電廠，裁罰不當利得高達4.4億元天價。

農委會近日向環保署了解行政罰法的相關作法，環保署長沈世宏24日在立院遇到農委會主委陳保基，更當面向他建議「不必修法，直接追討不當利得更有效！」陳保基表示「會考慮」。
