開罰遭撤銷　公平會將考慮是否重新處分

【戴安瑋／台北報導】公平會去年對9家民營電廠開罰63億元案，但被行政院訴願會以裁罰草率為由撤銷，公平會發言人孫立群表示，基本上，訴願會確認9家民營電廠有聯合行為，只是認為公平會裁處的63億金額不合理，公平會將在2 個月內決定是否重新處分。

孫立群說，公平會在裁罰該案時，確實面臨要選擇新的《公平法》還是舊的《公平法》來懲處，經詢問法務部後，決定採用新法，即採業者前1年營業額的10%開罰，而不是用舊法第41條罰鍰上限的2500萬元，訴願會認為公平會罰鍰計算不夠細緻，未分段斟酌罰鍰金額，公平會將再討論是否上訴還是重新處分。

他強調，至今訴願會目前只撤銷1家電廠的裁罰、尚未處理8家電廠的裁罰，公平會將待9家民營電廠的訴願結果後，再統一處理，最慢2個月內做出因應決定。
