王金平保住黨權　法院：非最後判決結果

【賴又嘉／台北報導】王金平假處分案，台北地院下午裁准王金平以938萬元擔保金擔保，繼續保有行使國民黨黨員職權的權利，王金平傍晚已派人到法院交繳938萬元。

至於合議庭在裁定指出，繼續保有王金平行使國民黨黨員權利的理由，主因這並不是最後的判決結果，而是讓有爭執的法律關係，斟酌雙方可能遭受的損失，暫時維持或保有一定的情況下，讓當事人從容地進行實體訴訟，以定紛止爭。
 
裁定中解釋，定暫時狀態處分，是在王金平提出「確認國民黨及存在」訴訟判決確定前，由法院就爭執的民事法律關係先定暫時狀態，防止發生重大損害或急迫危險，避免日後判決確定失去實益所設的救濟制度，也因此聲請人只需釋明「兩造間（王金平與國民黨）有爭執的法律關係」及「保全的必要性」就足夠。
