農團告劉政鴻 高院交由苗檢處理

農團當初選擇赴最高檢察署，就是質疑苗檢公信力，加上大埔案已經受到全國矚目，才希望檢察總長黃世銘能指定將本案交由特偵組偵辦。

但特偵組強調，必要時才會本於「檢察一體」的原則，依法院組織法規定，特偵組職司涉及總統、副總統、五院院長、部會首長或上將階級軍職人員貪瀆案件，劉政鴻被控辦理土地徵收過程圖利二億元部分，本案被告為縣長，尚非屬特偵組管轄案件，故應發交管轄權的苗栗地檢署依法偵辦。

特偵組還強調，近期嘉義縣長張花冠、南投縣長李朝卿縣長涉嫌貪瀆案，都是如此辦理，有關劉政鴻部分不該有特案。
