控《蘋果》翻攝侵權　《聯合報》二審仍敗訴

【孫友廉／新北報導】《蘋果日報》及網站2010年8月25日報導「摘邱毅假髮　黃永田賠30萬確定」時，翻拍使用《聯合報》2008年12月報導黃男掀邱毅假髮的現場照片，《聯合報》因此向《蘋果日報》求償100萬元及要求刊登澄清啟事，《聯合報》一審敗訴後上訴智慧財產法院，但今仍敗訴。
 
智財法院認為，基於公共利益及《憲法》第11條保障人民知的權利，認定《蘋果》使用該照片屬合理使用，且《蘋果》也有標示「翻攝畫面」，該報導又刊登在《蘋果》A9版左下方，篇幅極其微小，加上《聯合報》無法證明受有損害，因此仍判《聯合報》敗訴；全案尚可上訴。
