拆ㄇ型管遭控毀損　童仲彥不起訴

【賴又嘉／台北報導】台北市議員童仲彥去年因接獲民眾陳情，指萬華區某街道設置的ㄇ型管夜晚常害機車騎士摔車，去年10月9日派工強行拆除該ㄇ型管及「私人土地禁行機車」的告示牌，卻遭設置該ㄇ型管的陳姓民眾控告毀損、強制等罪。
 
童仲彥辯稱設置該ㄇ型管對當地居民造成很大影響，且新工處認定ㄇ型管為公物，還有里長親筆信及社區連署信，可證明ㄇ型管設置對居民造成影響。北檢審酌該處道路為公有地，童仲彥拆除ㄇ型管不構成強制罪，且事後陳姓民眾已對毀損部分撤告，今將童仲彥不起訴。
